Writing Peers – Terms of Service for NovelPlotter

1. Introduction
These terms of service govern your access to and use of the NovelPlotter tool provided by Writing Peers, located in the Netherlands.

2. Acceptance of Terms
By clicking “I Agree” or by accessing and using NovelPlotter, you agree to be bound by these terms. If you do not agree with these terms, you must not use the service. Continued use of the service after any changes or updates to these terms constitutes acceptance of those changes.

3. User Accounts and Security
You are responsible for maintaining the confidentiality of your login information and for all activities that occur under your account. Writing Peers is not liable for any loss or damage resulting from unauthorized use of your account.

4. User Conduct
You agree to use NovelPlotter in accordance with the following conduct policy:

• You may not upload, post, or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• You may not transmit content you do not have the right to share, such as proprietary or confidential information.
• You are prohibited from uploading content containing viruses, malicious software, or any form of harmful code.
• You must not engage in activities that disrupt the services or networks connected to NovelPlotter.
• Impersonation of others, including employees or representatives of Writing Peers, is prohibited.
• Any attempt to access or interfere with other users’ accounts or the service’s systems without authorization is forbidden.

Violations of this policy may result in suspension or termination of your account, as deemed appropriate by Writing Peers.

5. Subscriptions, Payments, and Refunds

• Subscriptions: Writing Peers offers subscription plans for NovelPlotter, which are billed on a recurring basis, either monthly or annually.
• Automatic Renewal: Subscriptions will automatically renew at the end of each billing cycle unless canceled by the user through their account settings.
• Refunds: Refund requests must be made to Writing Peers’ customer support. Refunds may be granted at our discretion if requested within 14 days of the transaction. After this period, refunds will not be processed.
• Cancellation: Users may cancel their subscription at any time through their account settings. Cancellations will retain access to subscribed features until the end of the current billing cycle. No refunds will be given for the remaining days of the subscription.

6. Intellectual Property and License

• Any content you create, write, or upload to NovelPlotter remains your property. Writing Peers does not claim ownership of this content.
• All other content, software, and services provided by Writing Peers remain the intellectual property of Writing Peers.
• You may not redistribute, modify, reverse engineer, or create derivative works of NovelPlotter without prior written permission from Writing Peers.

7. Disclaimers and Limitation of Liability

• As Is: NovelPlotter is provided “as is” and “as available” without any warranties, express or implied.
• Limited Liability: Writing Peers’ liability for any direct damages arising from the use of NovelPlotter is limited to the amount paid by the user during the 12 months preceding the event. Writing Peers is not liable for any indirect, special, incidental, or consequential damages.

8. Termination
Writing Peers reserves the right to suspend or terminate your account without prior notice if you violate these terms. Users may terminate their use of NovelPlotter at any time by deleting their account and all associated content.

9. Governing Law and Jurisdiction
These terms are governed by the laws of the Netherlands. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts in the Netherlands.

10. Changes to Terms
Writing Peers reserves the right to modify these terms at any time. Users will be notified of any significant changes, and continued use of NovelPlotter after such changes signifies acceptance of the updated terms.

11. Third-Party Services
NovelPlotter may include links to third-party services. Writing Peers is not responsible for the content, policies, or practices of these third parties. Users access and use third-party services at their own risk.
